These Terms and Conditions govern the provision of man and van and related removal services by Man with Van West Hampstead. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, partnership, company or organisation that requests and/or pays for the services.

Services means man and van, removal, transport, loading, unloading, packing, unpacking, and any other related services that we agree to provide.

Goods means the items, belongings and property that we are required to handle, transport or store in connection with the services.

Vehicle means any van or other vehicle used by us to provide the services.

We, us and our mean the service provider trading as Man with Van West Hampstead.

2. Scope of Services

We provide man and van and removal services primarily in West Hampstead and surrounding areas, including collection, loading, transportation and unloading of goods, and any additional services agreed in advance.

Our services are limited to what is expressly agreed at the time of booking. We are under no obligation to perform tasks that fall outside the agreed scope, such as specialist disconnection of appliances, dismantling or reassembly of complex furniture, or handling prohibited items, unless confirmed in writing prior to the service date.

3. Booking Process

All bookings must be made directly with us and are subject to availability. A booking is only confirmed when we have accepted it and provided you with a booking confirmation.

To make a booking, you must provide accurate and complete information regarding:

Pickup and delivery addresses.

Access conditions at each address, such as floor level, stairs, lifts, parking restrictions and distance to property.

The nature, approximate quantity and approximate weight of the goods.

Any particularly heavy, fragile, high-value or bulky items.

Your requested date and time for the service.

We reserve the right to refuse or cancel any booking where the information provided is inaccurate, incomplete, misleading or where we reasonably believe the work cannot be carried out safely, legally or within the capacity of our vehicles and staff.

4. Estimates and Quotations

Any estimate or quotation provided is based on the information you have supplied. If, on arrival, the actual work required differs from the information given, we may adjust the price to reflect the additional time, distance, labour, parking costs or other factors reasonably incurred.

Unless stated otherwise, quotations are exclusive of congestion charges, tolls, parking charges, fines, ferry charges or additional access costs, which will be passed on to you at cost where applicable.

Where we provide a time-based rate, the chargeable time begins when the vehicle and staff arrive at the agreed collection address and ends when unloading is complete at the final delivery address, including any reasonable travel between addresses and any waiting time attributable to the customer.

5. Customer Responsibilities

You are responsible for:

Ensuring appropriate parking and access are available at both collection and delivery locations, including obtaining any permits or permissions where required.

Ensuring all goods are properly packed, labelled and ready for loading, unless we have expressly agreed to provide packing services.

Supervising the loading and unloading process where reasonably possible and checking that all goods are correctly loaded before departure and fully unloaded on arrival.

Removing or securing any loose fittings, fixtures or items that may present a hazard during removal.

Complying with all relevant laws and regulations, including waste and environmental legislation.

You must not ask our staff to undertake any action that could be unsafe, unlawful or likely to cause damage to property or goods.

6. Payments and Charges

All charges will be communicated to you at the time of booking or as soon as reasonably possible thereafter. By confirming a booking, you agree to pay the full charges applicable to your service.

Payment terms will be specified in your booking confirmation. We may require full or partial payment in advance, a deposit, or payment on completion of the service. We reserve the right to refuse to commence or continue the service if payment terms are not met.

Additional charges may apply for:

Extended waiting times beyond our control, including delayed access to the property.

Additional labour required where the actual work exceeds the estimate.

Parking fees, congestion charges, tolls, fines caused by inadequate parking arrangements, and other third-party charges incurred during the service.

If payment is not received by the due date, we may charge interest on overdue amounts at the statutory rate and may suspend or cancel any further services.

7. Cancellations and Amendments

You may cancel or amend your booking by giving us reasonable notice. The following terms will normally apply, unless varied in your booking confirmation:

If you cancel more than 48 hours before the scheduled start time, you will generally not be charged a cancellation fee, and any deposit paid may be refunded or held as credit at our discretion.

If you cancel within 24 to 48 hours of the scheduled start time, we may charge a reasonable cancellation fee to cover administrative costs and any loss of business.

If you cancel within 24 hours of the scheduled start time or fail to be present at the agreed time and place, we reserve the right to charge up to the full estimated price of the service.

If you wish to amend the booking details, such as date, time, addresses or scope of work, we will make reasonable efforts to accommodate the change but cannot guarantee availability. Any change may result in a revised quotation or additional charges.

8. Access, Parking and Delays

You must ensure that our Vehicle can park and safely access the property at both the collection and delivery locations. This includes arranging necessary parking permissions, permits or visitor passes where required.

If suitable parking is not provided or is unavailable, we may need to park further away, which may increase the loading and unloading time and therefore the total charge.

We are not responsible for delays caused by circumstances beyond our reasonable control, including but not limited to traffic conditions, road closures, restrictions, accidents, weather, industrial action or delays caused by third parties. We will use reasonable efforts to keep you informed of any such delays.

9. Goods Not Accepted

We will not carry or store the following items, and you must not include them in any goods handed to us:

Explosive, dangerous, flammable or hazardous materials, including gas bottles, petrol, paint thinners and similar substances.

Illegal items, stolen goods or items obtained unlawfully.

Perishable goods that may deteriorate in transit.

Cash, securities, precious metals, jewellery, valuable collections, or other high-value items unless we have agreed to this in writing in advance.

Animals, plants or other living organisms.

If such items are transported without our knowledge, we accept no liability for them, and you will be responsible for any loss, damage, cost or claim arising from their presence.

10. Waste and Environmental Regulations

We comply with applicable UK waste and environmental regulations. We are not a general waste disposal service and will not remove household rubbish, building waste or other controlled waste unless this has been expressly agreed as part of the booking and can be carried out in compliance with applicable law.

You must not present items for removal that are classed as hazardous or controlled waste without first disclosing this and obtaining our agreement. Where we agree to remove such items, additional charges and specific terms will apply.

If, during the course of the service, waste or items unsuitable for regular transport are identified, we reserve the right to refuse to carry them and, if necessary, to terminate the service in respect of those items without any liability for resulting loss.

11. Our Liability for Loss or Damage

We will exercise reasonable care and skill in providing the services. Our liability for loss of or damage to goods is subject to the terms below.

We are not liable for:

Loss or damage arising from your failure to adequately pack or protect goods, unless we have agreed to provide professional packing and have done so.

Loss or damage to goods where the condition or fragility of the item makes it unsuitable for transport, or where pre-existing defects are present.

Loss or damage caused by your acts or omissions or those of any third party, including where you or your representatives assist with loading or unloading.

Indirect or consequential losses, including loss of profit, loss of opportunity or loss of enjoyment.

Our total liability for loss of or damage to goods, whether arising from breach of contract, negligence or otherwise, will not exceed a reasonable replacement value of the affected items, subject to any specific limitations advised in your quotation or booking confirmation.

You should arrange your own insurance for high-value or irreplaceable items. We do not provide insurance advice and do not accept liability for items that are not reasonably insurable.

12. Claims and Complaints

If you believe any goods have been lost or damaged, or if you are dissatisfied with the services, you must notify us as soon as reasonably possible and provide full details of the issue.

Any visible loss or damage should be noted on completion of the service or within a reasonable period thereafter. You may be required to provide photographs, receipts or other evidence to support your claim.

We will investigate all reasonable complaints and will endeavour to resolve them in a fair and timely manner. Our decision on liability will take into account these Terms and Conditions, the evidence provided and any applicable law.

13. Customer Indemnity

You agree to indemnify us against all losses, claims, costs, damages and expenses we incur arising out of:

Your breach of these Terms and Conditions.

Your failure to disclose relevant information, including hazardous items or access limitations.

Any claim brought by a third party in connection with the goods or the services, where such claim results from your act or omission.

14. Health and Safety

We are committed to operating in a safe manner. Our staff may refuse to carry out any activity that they reasonably consider unsafe, likely to cause damage to property or goods, or contrary to health and safety requirements.

You must ensure that the premises are safe and that any known risks, such as loose flooring, hazardous materials or defective stairs or lifts, are highlighted to us before work begins.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to extreme weather, accidents, road closures, acts of God, strikes, lockouts, civil disturbances or acts of government.

If a force majeure event occurs, we will use reasonable efforts to notify you and to rearrange the services at a mutually convenient time.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services.

17. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and us in relation to the services and supersede any prior discussions, understandings or agreements.

No failure or delay by us in exercising any right or remedy shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

We may update or amend these Terms and Conditions from time to time. The version applicable to your service will be the version in force at the time of your booking, as made available to you at or before confirmation.
